BrainDash LLC ("we", "us", "our") operates braindash.co. This policy explains how we collect, use, share, and protect your personal information. By using BrainDash, you agree to this policy.

1. Information We Collect

Account data: Email address, date of birth, display name, state of residence
Identity verification (KYC): Government-issued ID, selfie — processed by our KYC provider and not stored on our servers
Financial data: Payment method details processed by Stripe — we store only transaction IDs, amounts, and status
Gameplay data: Match history, scores, win/loss records, session timestamps, question responses
Device & technical data: IP address, device type, operating system, browser type, push notification tokens
Communications: Support tickets and emails you send us

2. How We Use Your Information

To operate the platform and process payouts
To verify your age (18+) and identity (KYC/AML compliance)
To enforce geographic restrictions under applicable state law
To detect fraud, cheating, and maintain platform integrity
To comply with tax reporting obligations (IRS Form 1099)
To send push notifications you have opted into
To respond to support requests
To comply with legal obligations and law enforcement requests

3. Data Sharing

We do not sell your personal data. We share data only with:

Stripe: Payment processing, payouts, and identity verification
Supabase: Database and authentication hosting (SOC 2 Type II compliant)
Law enforcement: When legally required by court order, subpoena, or applicable law
Fraud prevention: With third-party fraud detection services as necessary

4. Data Retention

Financial records: 7 years (IRS/AML compliance requirement)
Account data: Until account deletion, then 90 days
Gameplay data: 3 years for dispute resolution purposes
KYC records: As required by our KYC provider's compliance obligations

5. Cookies & Tracking

We use localStorage and sessionStorage for authentication tokens and user preferences. We do not use third-party advertising or tracking cookies. We do not use device fingerprinting or cross-site tracking.

6. Security

All data is encrypted in transit (TLS 1.3) and at rest (AES-256). We use row-level security (RLS) on all database tables, ensuring users can only access their own data. In the event of a data breach affecting your personal information, we will notify you within 72 hours as required by applicable law.

7. Your Rights

Access: Request a copy of your data by emailing privacy@braindash.co
Deletion: Request deletion of non-financial data. Financial records must be retained per legal requirements
Correction: Request correction of inaccurate data
Portability: Request your data in a machine-readable format
Opt-out: Opt out of push notifications via device settings or in-app notification settings

8. CCPA Rights (California Residents)

California residents have the right to: know what personal information we collect and how it is used; delete personal information we hold about you (subject to legal retention requirements); opt out of the sale of personal information (we do not sell personal information); and non-discrimination for exercising your privacy rights. To exercise these rights, email privacy@braindash.co.

9. COPPA (Children's Privacy)

BrainDash is strictly for users 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If we discover that a user is under 18, their account will be immediately suspended and funds returned. If you believe a minor has created an account, contact privacy@braindash.co immediately.

10. Age Requirement & Verification

BrainDash is strictly for users 18 years of age or older. We verify age at signup and require identity verification for cash play. Providing false age information violates these terms and may constitute fraud.

11. Changes to This Policy

We will notify you of material changes to this policy via email at least 14 days before they take effect. Continued use of BrainDash after the effective date constitutes acceptance.
